Digital Millennium Copyright Act Policy

At Nisha Infotech, we uphold the sanctity of intellectual property rights, just as we expect others to respect ours. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their agents may submit a takedown notice to us via our designated DMCA Agent listed below. As an internet service provider, we are entitled to claim immunity from infringement claims under the “safe harbor” provisions of the DMCA.

To submit a good faith infringement claim, please provide us with a notice containing the following information:

Notice of Infringement – Claim

  1. A physical or electronic signature of the copyright owner (or an authorized representative).
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the infringing material, along with sufficient information to locate it (please include the URL of the allegedly offending work).
  4. Contact information of the complaining party, including name, physical address, email address, phone number, and fax number.
  5. A statement by the complaining party, made in good faith, that the use of the material is unauthorized by the copyright agent.
  6. A statement that the information provided is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Pursuant to Title 17 USC §512(f), penalties including costs and attorney fees may be imposed against any individual who knowingly and materially misrepresents information in a notification of infringement.

Please send all takedown notices through our Contact page, preferably via email, for prompt attention. Kindly note that we may share the identity and information of any copyright infringement claim we receive with the alleged infringer.

Counter Notification – Restoration of Material

If you have received a notice of takedown due to a copyright infringement claim and believe it to be in error, you may submit a counter notification to have the material restored. Your counter notification must contain the following elements as per 17 USC Section 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material taken down and its original location.
  3. A statement, under penalty of perjury, asserting your good faith belief that the material was removed or disabled due to mistake or misidentification.
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court.
  5. Send your counter notice through our Contact page, with email being the preferred method.

Repeat Infringer Policy

We have a zero-tolerance policy towards copyright infringement. Under the DMCA’s repeat infringer policy, we maintain a record of DMCA notices and make diligent efforts to identify repeat infringers. Accounts found in violation of our internal repeat infringer policy will be terminated.
